This Fair Use Policy (the “Policy”) forms part of, and should be read together with, Octonity’s Terms of Service (the “Terms”) and, where applicable, the AppSumo Lifetime Deal Terms. Capitalised terms not defined here have the meaning given in the Terms. It applies to every plan — free, subscription, and lifetime — and exists so that the shared, metered resources behind the Services (compute, AI capacity, storage, bandwidth, and third-party API quotas) remain available, affordable, and reliable for all users.
1. The Principle
Use the Services in the way a reasonable customer on your plan would, for your own genuine social-media work, within the limits of your plan or tier. Do not use the Services in a way that is abusive, deceptive, unlawful, or that consumes a disproportionate share of shared resources relative to your plan. Where your plan states quotas (for AI credits, workspaces, social accounts, scheduled posts, storage, exports, seats, and similar), those quotas are the primary expression of fair use; this Policy governs conduct in addition to, and around, those quotas.
2. Prohibited Conduct
You must not, and must not permit anyone to:
- Spam. Send unsolicited or bulk commercial messages through the Services or a Connected Channel, engage in coordinated inauthentic behaviour, or publish deceptive, misleading, or manipulative content.
- Scraping and unauthorised data collection. Scrape, crawl, harvest, or collect content or data from the Services, other users, or Connected Channels by automated means without authorisation, or in breach of any Platform’s terms.
- Excessive or automated AI usage.Consume AI features beyond your tier’s credits or rate limits, script or automate AI requests to generate volume disproportionate to normal human use, or use AI features to mass-produce low-value, spam, or synthetic content.
- Automated abuse. Run bots, crawlers, load generators, or unthrottled bulk operations that place an excessive load on the Services or the systems they connect to, or that are designed to inflate usage.
- Account sharing beyond plan limits.Share a single account, workspace, or seat among more people or organisations than your plan permits, or pool multiple users’ work into one seat to avoid buying additional seats.
- Resale. Resell, sublicense, rent, lease, or otherwise make the Services available to third parties as your own service, or transfer your account or lifetime licence except where expressly permitted (see the Terms and the AppSumo Lifetime Deal Terms).
- Circumventing limits. Attempt to bypass, reset, or defeat quotas, rate limits, metering, paywalls, or other technical restrictions — including by creating multiple accounts, rotating credentials, or exploiting bugs — to obtain more than your plan allows.
- Unlawful or harmful content. Upload, generate, publish, or transmit content that is illegal, infringing, defamatory, hateful, harassing, deceptive, or otherwise prohibited by the Terms or applicable law.
- Disproportionate burden.Engage in any activity that creates a technical or financial burden on Octonity or its providers that is disproportionate to your plan — for example, driving third-party API or AI-provider costs far beyond what your plan’s fees are designed to cover.
3. How We Assess Fair Use
Octonity assesses fair use in good faith, considering your plan or tier, published quotas, typical usage by comparable customers, and the impact of your usage on shared resources and third-party providers. Specific numeric thresholds and rate limits are set per plan and may be shown in-product or in your plan documentation, and may be adjusted over time to protect the reliability and sustainability of the Services. We will act proportionately and, where practicable, contact you before taking restrictive action for a first, non-malicious over-use.
4. Enforcement
If we reasonably believe your use breaches this Policy or the Terms, we may, proportionately to the breach and where practicable with notice:
- throttle, rate-limit, or temporarily pause the affected feature or account;
- require you to reduce usage, upgrade your plan, or purchase additional capacity;
- remove or disable access to offending content or automations;
- suspend the account; or
- terminate access for cause in accordance with the Terms, in serious, repeated, or malicious cases, or where required by law or by a third-party provider.
Where a breach threatens security, legal compliance, or the integrity or availability of the Services (or a third-party provider requires it), we may act immediately without prior notice and notify you as soon as reasonably practicable.
5. Appeals and Contact
If you believe an enforcement action was taken in error, or you need higher limits for a legitimate use case, contact support@octonity.com. We will review the matter in good faith. For legal questions about this Policy, contact legal@octonity.com.
6. Relationship to the Terms
This Policy supplements the Terms and, where applicable, the AppSumo Lifetime Deal Terms. A breach of this Policy is a breach of the Terms. If there is any conflict between this Policy and the Terms on the same subject, the Terms control, except that this Policy prevails on the specific detail of prohibited conduct and enforcement it describes.
